The Ministry of Home Affairs of India on August 11, 2025 announced the changes in the norms for OCI (Overseas Citizens of India). Authorities reportedly issued the gazette notification to state the modifications made in the regulations.

The government has made the changes in the Citizenship Act, 1955 and has introduced tougher norms for all the OCIs. As per the modifications, the authorities now can cancel the OCI cards anytime in case any suspicious activity is detected.
“In exercise of the powers conferred by the clause (da) of section 7D of the Citizenship Act, 1955 (57 of 1955), the Central Government hereby states that an Overseas Citizen of India (OCI) registration shall be liable to get cancelled when a person has been sentenced to imprisonment for term of not less than two years ar has been charge-sheeted for an offence entailing punishment of imprisonment for seven years or more.” reads the official notification released by MHA (Ministry of Home Affairs).
What the norms actually are?
There have been two necessary changes made from which one states that the OCI status will now be liable for cancellation anytime. To be specific-
- If the OCI card holder gets sentenced to an imprisonment of 2 years or more whether in India or Abroad, the card can be cancelled.
- If the card holder is accused of any of the criminal activity that could lead to seven or more years of imprisonment, whether it has been proved or not. The card will be liable for cancellation.
Earlier, there was a limitation on the time period for cancelling an OCI card. However, now as per the newly introduced regulations, all the limitations have been removed. According to the previous rules, the authorities could only cancel an OCI card within the period of five years of its issued date or the crime committed.
Although now, the cancellation can be enacted anytime the authorities sense any irregularity or suspiciousness.
OCI is a privilege not a Right: Government
The Indian Government has casted light on the OCI scheme stating that it is an advantage given to the foreign citizens having origins from India. However, it is not right.
Officials highlight that the changes made to the rules and regulations were necessary to consider. It stated that these aim at safeguarding the integrity of the scheme. Also, this directly relates to the safety and security of Indian nations.
As per the previous records, there have been 122 cancellations from 2014 to 2023. If taken the data of 2024, there were 57 OCI cards cancelled in just one year. And, the data of the current year till May only reveals 15 cancellations.
Such numbers clearly mark the need of the action which has been taken by the authorities for the sake of strengthening security grounds of India.
Who are OCIs?
Overseas Citizen of India (OCI) is an immigration status that is given to the Indian Government as per the Citizenship Act 1955. This states that OCIs are the foreign citizens who have the origins from India. In simple words, OCIs are former Indian citizens. As India does not allow dual citizenship, OCI status offers permanent residency to the ones belonging to this category. The OCIs holds several of the advantages such as Visa free travel to India, Right to own property in India.
